WEBSITE ETIQUETTE

WE EXPECT EVERY GASRIAN TO BE CIVIL TO ONE ANOTHER AND TREAT EVERYONE WITH RESPECT

We understand that not everyone is going to get along; We have a very diverse community and personalities are bound to clash. However, it is expected at minimum you will communicate to other members and staff in a professionally courteous tone, free of ill-mannerisms.

HARASSMENT WILL NOT BE TOLERATED

"Harassment" could include the following:
  • Posting inappropriate, rude, or threatening comments in public or private anywhere on Art Haven.
  • Creating an alternative account in order to contact a person who has added you to their ignore list and/or explicitly asked for you to leave them alone.
  • Creating an account for the purpose of trolling.
  • Threatening to commit either physical or emotional abuse to another person.
  • Posting someone's name in a negative light; Includes public blacklists.
  • Using harmful language such as racial slurs, LGBT+ spectrum slurs, or maliciously swearing to another member.
  • Death threats including telling someone that they should die in any way, shape, or form, explicitly or implied. Death threats can lead to an automatic permanent ban from Art Haven.
Wikipedia on Trolling: Sows discord on the Internet by starting arguments or upsetting people, by posting inflammatory, extraneous, or off-topic messages in an online community (such as a forum, chat room, or blog), either accidentally or with the deliberate intent of provoking readers into an emotional response or of otherwise disrupting normal on-topic discussion.

POSTING RESTRICTIONS

SPAMMING IS NOT ALLOWED

Spam constitutes as:
  • Posting irrelevant replies multiple times
  • Replying 3 times in a row, i.e., there are no users posting between your posts (this excludes bumping when done every 10 hours)
  • Posting potentially harmful links to scams/websites
  • Having an excessive amount of off-topic chatter in shops or other places where it is not appropriate
  • Soliciting off-site entities both public and private (including via PM)

TOPIC BUMPING

Bumps are allowed every 12 hours or 12 hours after the time of the last post in your topic. This rule is in place to give everyone an opportunity to have their topic on the front page. If you post bumps more frequently than this, it is considered to be spam and will be dealt with in the same manner. Our bumping system has an automatic timer to prevent misuse of the button.

OFFSITE RESTRICTIONS

Promoting your services via social media or other websites (auction, commissions, products, etc.) is allowed on Art Haven with exceptions for the following areas:
  • Shop Topics & Listings - You cannot post a link or create a topic/listing within our marketplaces for the purpose of directing members to another website or application in order to make a purchase, receive order updates, or receive the final product/service. For the safety of our community, the transaction needs to be followed through completely on Art Haven in order to sell on our platform.
  • Private Messages - Abusing our messaging system to send unsolicited advertisements to members is not allowed. Depending on the scale of the abuse, this could also be considered spam and can result in your account being banned. This is permanent and cannot be reversed.

If you're interested in reaching a larger portion of our community, we offer competitive advertisement options such as, [ banner ads ] and featured ads. Banner advertisements can be purchased via Art Haven's Store and can be used for offsite services. If you're interested in having your shop/topic featured on the dashboard and listed first within a topic list, you can purchase a Shop Pin directly within your topic. There are a limited number of slots, so the option to purchase a Shop Pin will only display when a slot is availiable.

EXPLICIT CONTENT MUST BE MARKED MATURE

Art Haven hosts a diverse community of members as young as 13 years of age. Some content can be considered objectionable or offensive to some members, while that same content is considered okay to other members. Explicit content is considered mature content we don't want a member to come across that could potentially be unsuitable for general audiences and workplace environments. All explicit content marked mature will be given a content filter warning. This warning will let any user(s) viewing it know that it may contain explicit themes and to take caution before viewing. Only members who are 18 years of age or older AND have mature content turned on via their account settings will be able to view explicit content marked mature.

Mature content may include:
    Nudity or sexually explicit content
  • Full or partial nudity
  • Gratuitous or explicit display of breasts, buttocks, and sexual organs intended to stimulate erotic feelings
  • Sexually themed content or depiction of any sexual activity, explicit or implied

  • Provocative, inflammatory, unsettling, or suggestive content
  • Sexually explicit language, gestures, or expressions
  • Provocative scantily clothed men or women
  • Discussions about sexual experiences or fetishes
  • Non-sexually explicit content that makes an average person squeamish or disgusted (ex: excessive gore, body mutilations
Examples of nudity or sexually explicit content:
See-through clothing, bondage/bdsm themes, use of toys and other sexual objects, exposed or clearly defined genitalia, some images of exposed or clearly defined female nipples/areolas, exposed butts in thong underwear or lingerie, semen, ahegao, linking to sexually explicit content.

IMPORTANT: Special exceptions provided to non-humanoid species, such as furries and aliens, where body parts are covered naturally or don’t exist normally. Exceptions void if species are humanoid, or given human anatomy.

Examples of non-sexually explicit content:
Excessive blood, body mutilation, injuries, bodily fluid extraction, dismembered body parts, mild violence, linking to explicit content.

ARTISTIC OR EDUCATIONAL NON-EXPLICIT THEMES AND NUDITY IS ALLOWED

While there is many a debate over what qualifies as artistic nudity, we at Art Haven believe the following: Artistic nudity at its core seeks to purposefully portray the human body in its purest form, whereas explicit nudity seeks to capitalize or thoughtlessly include nudity for its novelty. The difference between these two portrayals of nudity ultimately lies within the context in which it is presented and in the intention of the works.

For example, the statue of David by Michelangelo is a deception of the biblical figure David in full nudity. The context is of a heroic figure, David, being sculpted during the Renaissance and the intention of this piece is to honor David. Though the male genitalia is visible, it is not sculpted with the intention to evoke arousal. David's nudity is not a wanton decision, but rather a purposeful decision made in order to enhance the piece and give glory and respect to the religious figure.

In contrast, mature/sexually explicit content often contains nudity for the sake of nudity. Its intention is to be sexual, elicit arousal, or be suggestive and novel. For example, if an artist were to draw a nude female subject bent over the hood of the car with her legs spread, then the context here is to sexualize the female body. She is intentionally positioned in such a way as to mimic a sexual position. There is no real reason for her to be nude and bent over a car other than to have her be nude and bent over a car.

Examples of non-explicit artistic nudity:
We can only provide a referenced starting point for what is allowed as we cannot exclusively define what is “art” and what is not. While each case may vary, any content that creates doubt or uncertainty will cause staff to err on the side of caution and possibly mark the content as mature.


Self-Censorship
We know some artists will attempt to censor their artwork in order to make it suitable to post publicly by cropping, blurring, color-blocking, or covering more explicit or sensitive portions of their work prior to posting. While this is allowed, some artists fail in their attempt to censor and usually do not censor correctly. Sexually explicit content depicting sexual acts or scenes, for example, cannot be posted publicly even if censored. If you choose to post censored works that fail to meet guidelines, you accept any consequences as a result, including the removal of the content and possible disciplinary action.

IMAGES POSTED MUST BE PSE FRIENDLY

Users must not post anything that may trigger a Photosensitive Epilepsy (PSE) episode for those who suffer from such symptoms. Images that trigger PSE include but is not limited to flashing lights, especially with contrasting visual patterns, faster than 3 frames per second. Please visit http://wikipedia.org/wiki/PSE for more information. If you suffer from PSE and find an image bothersome, please report it using our reporting tools and explain that the photo may contradict our PSE guidelines.

YOU CANNOT USE A DISPLAY PICTURE/ARTWORK THAT DOES NOT BELONG TO YOU

Unless you have WRITTEN PERMISSION from the artist, you may not use artwork that is created for someone else. However, you can use images such as anime screenshots or GIFs from Tumblr/GIPHY/etc but you must provide credit to the creator. These images cannot be resold.

Rule of Thumb: If you didn’t pay for it, you probably shouldn’t be using it.

REFERENCES ASSOCIATED TO HATE GROUPS SUCH AS THE NAZI PARTY, KKK, ISIS, ETC. ARE PROHIBITED.

This includes:
  • Symbols
  • Easily identifiable clothing
  • Propaganda

PROHIBTED CONTENT

CONTENT THAT GOES AGAINST ART HAVEN’S T.O.S AND COMMUNITY GUIDELINES MAY NOT BE POSTED ON THE WEBSITE OR VIA PRIVATE MESSAGE

This includes:
  • Racism
  • Sexism
  • Animated Pornography
  • Lolicon/Shotacon/Child-Like Pornography
  • Extreme Sexual Themes
  • Animal Abuse/Bestiality
  • Extreme Acts of Violence or Depictions of Criminal Activity
  • Drug Usage (excluding the use of tobacco and other legal substances)
Posting any of the following will result in a 30-day ban from the website with no prior warning.

THE USE OF AI GENERATORS TO CREATE ARTWORK FOR SALE AND INSERTING COPYRIGHTED WORKS UPLOADED TO ART HAVEN INTO AI GENERATORS IS STRICTLY PROHIBITED.

What is allowed:
  • Using AI generated artwork to practice your skills and complete photo studies so long as they are not sold, used as examples of your artwork, or claimed as your own creations.
  • Posting photo studies of AI generated content to the Gallery, so long as they are labeled properly as a photo study and for practice only.
What is NOT allowed:
  • Selling AI generated artwork or claiming the generated artwork as your own creation.
  • Taking purchased artworks or any artwork uploaded to Art Haven and inserting it into an AI generator.
  • Taking copyrighted images and inserting it into an AI model then selling it on Art Haven.
  • Selling artwork that was traced, edited, or manipulated from an AI generated creation.
Posting any of the following will result in a 30-day ban from the website with no prior warning.

THE SALE OR DISPLAY OF NFTs THAT WERE NOT CREATED OR SOLD BY THE ORIGINAL ARTIST IS PROHIBITED.

What is allowed:
  • Selling NFTs as long as you are the artist and it's a guaranteed original.
  • Advertising NFTs as long as you are the original artist of said NFT.
What is NOT allowed:
  • Turning any artwork that is uploaded on Art Haven into NFTs.
  • Taking a purchased artwork and selling it as a NFT.
  • Using NFTs to advertise malicious intentions.
    Notice: Art Haven does not support nor encourage NFTs due to the associated risks and harm it can cause. If you choose to partake in it, we encourage you to do thorough research on the subject.  
Posting any of the following will result in a 30-day ban from the website with no prior warning.

Copyright Infringement

YOU MAY ONLY SELL CREATIVE WORKS THAT DO NOT VIOLATE WHAT WE HAVE DEFINED AS COPYRIGHT INFRINGEMENT.

If you believe in good faith that someone is using your content without authorization, please fill out our quick and easy DMCA Takedown Request form. This form can be filled out on a user’s behalf if given authorization. Please make sure you fill out the form completely to avoid delays in processing. If you do not own the content being infringed upon and are not authorized to represent the owner of the content, please use the report button located directly on the content to send a report in to the staff team using the DMCA Violation reason. The more information you provide to us about the possible violation, the quicker we will be able to process it.

IF YOU SUSPECT SOMEONE OF STEALING, DO NOT POST THE MATTER PUBLICLY

We are a community that believes in second chances. Please let staff handle the matter, as speaking against the user in public is considered harassment. If there is content you would like report, please do so by reporting the post (on the top right corner of the post ) or by sending a ticket via Support.

WE CANNOT BE HELD ACCOUNTABLE FOR REIMBURSING ANY CURRENCY THAT YOU SPENT ON STOLEN ART

Although Art Haven is able to punish those who have been proven to sell stolen art on our website, we do not have the ability to force the individual to return the money that was wasted on stolen art. You will need to use all available outlets at your disposal to try and retrieve back any lost payments, including refund requests via PayPal.

WE MAY LOCK SHOPS ON OCCASION TO ASK FOR PROOF BEFORE ALLOWING YOU TO CONTINUE SELLING ON ART HAVEN

This is just a measure we use for everyone's safety due to how often theft is committed on our website by users who do not understand the various forms of copyright infringement. This is NOT something we do lightly, however, if there is reason to suspect a person of selling stolen/illegitimate art, we will not hesitate to ask them for sufficient proof before they are allowed to continue selling art on Art Haven. This is to ensure the safety of all our members.

WE CANNOT DO ANYTHING ABOUT OFF-SITE THEFT

If someone has stolen your picture or is selling stolen artwork on a website outside of Art Haven --such as Tumblr, Facebook, or DeviantART-- unfortunately the staff here cannot help you with that. Instead, here are some suggestions for you to do:
  • Contact the original artist of the artwork and let them know
  • Try reporting the individual on that website.
  • File a DMCA takedown if you are the original artist, following DMCA procedures specifically outlined on the website.

Fraud

FRAUDULENT ACTIVITY

We understand that there is a good possibility a new or existing user can be dishonest other users by whatever means, and will take the appropriate precautions to keep cases like these as unlikely as possible. However, we will never accuse anyone of fraud without substantial proof. Please report any suspicious activity via support ticket.

Examples of fraud can include, but are not limited to:
  • A buyer consistently fails to pay for commissions and/or fails to properly communicate with sellers within a reasonable time frame regarding payments.
  • A buyer consistently files disputes against artists for illegitimate reasons.
  • A seller consistently fails to deliver goods or services commissioned by a buyer and/or fails to properly communicate with buyers within a reasonable time frame regarding delivery of goods or services.
  • A seller attempts to redistribute sold goods to multiple users without their consent or prior knowledge that the goods were not intended for a single owner or entity.

FRAUDULANT DISPUTES AND CHARGEBACKS ARE NOT TOLERATED

You must contact us with any billing questions or discrepancies. Performing a chargeback or dispute with your card issuer against any purchases made in the Art Haven store, Art Haven Exchange, or anywhere else a transaction is completed using our checkout system will result in immediate and permanent account termination. We keep detailed records of all transactions that we will fax over to any company a dispute is filed at to counter against any claims. There are no reversals to this decision, regardless of who wins the case.

If you are suspended while having an active membership, your membership will continue to run and will not be extended. If you are banned while having an active membership, your membership will be cancelled and no refund acknowledge as stated in the subscription terms you agreed to when you purchased the membership.

Copying

COPYING OTHER ARTISTS ARTWORK IS A SERIOUS OFFENSE AND SHOULD BE REPORTED USING ART HAVEN SUPPORT

However, below is a list of contents an artist cannot own. This list will be updated as we feel fit and is not strictly limited to the following items:

FONTS (JELLYKA, TIMES NEW ROMAN, PAPYRUS, ETC.)

Fonts belong to their respective owners and many users here use downloadable fonts that are free for public use. You cannot use another user's' handwriting if they have not made it public. (Don't copy and paste letters to make a word).

SIMILAR USERNAMES (INFECT VS INJECT, MOON1 VS MOON ETC.)

We cannot issue a warning for a user having a similar name to you. We can only issue a warning if they are impersonating that user.


Please note: if several of these elements are combined, it will no longer be seen as a coincidence and will be looked into. Should we find this crosses the line into copying, this may result in a warning.

COPYING OTHER ARTISTS ARTWORK IS A SERIOUS OFFENSE AND SHOULD BE REPORTED USING ART HAVEN SUPPORT

However, below is a list of contents an artist cannot own. This list will be updated as we feel fit and is not strictly limited to the following items:

THEMES (VINTAGE, PASTEL, SUCCUBUS, ETC.)

No artist can claim they own a theme. You cannot report a user due to them using the same theme you have.

COLORS (RED, GOLD, BLACK, ETC.)

You cannot own a color. If someone else uses the same color as you, it is not theft. Only when the composition and the colors match may we look at it as a possible case of infringement.

PLACEMENT OF AN OBJECT (EYES LOOKING UPWARD, FLOWERS IN THE CORNER OF AN ICON, LACE BORDERS, ETC.)

You cannot own common concepts. For example: you cannot report a user for using lace just because you may have used lace in one of your own pieces.

BASIC ART CONCEPTS (DROP SHADOWS, 1PX BLACK BORDERS, ETC.)

These are basic art concepts all artists do and some are built into programs already.

DRAWN BODY PARTS (FEET, BUTTS, ARMS, ETC.)

You cannot claim ownership over a body part. All users are free to make pictures of shoes, butts, arms, legs, chests, etc.

WORK CREATED FROM A TUTORIAL

Although it's best to use tutorials to learn, some allow you to sell what you make with them... such as the popular rose tutorial on deviantART. We cannot issue warnings for users selling this (as it is permitted), nor can we issue warnings for other users making the same rose. It is a public tutorial.

POSE (STANDING STRAIGHT UP, SITTING DOWN, JUMPING, ETC.)

You cannot own the way the body moves.

PARTS OF AN OC (BLUE HAIR, PALE SKIN, ETC.)

An OC is an original creation. Although you cannot make your OC identical to another OC, you cannot claim they copied on simple things such as the same hair color, same skin color, same age, etc. If you create an OC using an off-site source, such as gaia tekteks, imvu/secondlife avatars, etc., you cannot report a user for using the same items as you.


Please note: if several of these elements are combined, it will no longer be seen as a coincidence and will be looked into. Should we find this crosses the line into copying, this may result in a warning.

COPYING OTHER ARTISTS ARTWORK IS A SERIOUS OFFENSE AND SHOULD BE REPORTED USING ART HAVEN SUPPORT

However, below is a list of contents an artist cannot own. This list will be updated as we feel fit and is not strictly limited to the following items:

SHOP TITLES

Stealing shop content (logo/banner/header images) is theft, however, if your shop name is Sunshine and somebody else also names their shop Sunshine - this is not theft.

ORDER OF POSTS (INTRODUCTION, EXAMPLES, PRICES, ETC.)

You do not own the order of your posts. We will not issue a warning for a user 'copying' your shop with the same order of posts.


Please note: if several of these elements are combined, it will no longer be seen as a coincidence and will be looked into. Should we find this crosses the line into copying, this may result in a warning.

SERVICES THAT ARE NOT ALLOWED TO BE SOLD ON ART HAVEN

CHARACTER DESIGNS BASED OFF A CREATION MADE FROM A "DOLL MAKER SITE" (SUCH AS GAIA, TEKTEK, DREAMSELFY,GACHALIFE OR MEEZ)

If you create a character/character design using any type of doll maker, you CANNOT sell that design for profit. You do not have the rights of the design, as you are using a premade doll maker website. You cannot sell any art made from these character designs as adoptables; they must be sold as a premade since again, you do not own the rights to the design, the website you used to make them does. The Gaia avatars/tekteks themselves cannot be sold at all as premades, adoptables, or customs. Free shops to create and give away custom or premade tekteks/Gaia avatars are not allowed. Also, you cannot charge for anything related to the making of tekteks (videos, etc).

ALTERNATIVE ACCOUNTS & ACCOUNT SHARING


SHARING ACCOUNTS IS NOT PERMITTED ON ART HAVEN

We do not allow account sharing for security reasons.  There is no reason for you to allow someone else to use your account.  If someone forgot their password or is having issues logging in, they need to click the "Contact" button at the bottom of the website to send us a support ticket.  

Please Note: If you allow a friend who is banned from Art Haven to log in or use your account, you are essentially putting your own account at risk of being automatically banned as well. Our systems track IP addresses from the moment of registration and/or successful log-in. It will attach their IP address to your account.

YOU ARE NOT ALLOWED TO CREATE AN ALTERNATIVE ACCOUNT, USE AN ALTERNATE ACCOUNT, OR SIGN INTO A FRIEND'S ACCOUNT WHILE YOU ARE BANNED FROM ART HAVEN

If you create other accounts while your main account is suspended, your new account will be merged with your main account, and you will be permanently banned from Art Haven. If you were permanently banned and created an account to bypass this, all IP addresses, emails, etc. will be permanently banned to prevent future account registrations. This is because you are essentially trying to undermine what you were punished for.

DEACTIVATING & DELETING ACCOUNTS

MEMBERS ARE NOW ABLE TO DEACTIVATE OR DELETE THEIR OWN ACCOUNTS

If you wish to delete your account, go to your account settings and select "Deactivate/Delete Account" under "Other Settings" located on the right. Clicking this option will direct you to the control page prompting you to choose to either deactivate or delete your account.

PLEASE READ THE FOLLOWING IMPORTANT INFORMATION ABOUT DEACTIVATING YOUR ACCOUNT

Deactivation will place your account on a type of hold and is not permanent. You will not be searchable, your profile will be hidden, members will not be able to message you, and you will not be able to access any part of Art Haven until the account is reactivated. Your account and all of your content will remain untouched otherwise.

Upon selecting the account deactivation option, you will be sent an email prompting you to confirm your selection. Once confirmed, you will receive a second email informing you that your account has been deactivated and will need to be reactivated before you are able to use it to access Art Haven again. You may reactivate your account at any time.

PLEASE READ THE FOLLOWING IMPORTANT INFORMATION ABOUT DELETING YOUR ACCOUNT

Deleting your account will permanently remove your account, including all of your content. You will be unable to access your account again.

Upon selecting the account deletion option, you will be sent an email prompting you to confirm your selection. Once confirmed, your request will be placed in a queue pending approval by a member of the administrative team. The administrative team will review and approve your request based on our deletion requirements. If your request is approved by the administrative team, you will have 30 days to cancel your request before your account is permanently deleted. This is irreversible, so please make sure this is what you want to do. If you aren't sure if you want to keep your account, deactivation is the best option so you do not lose anything.

We will delete accounts upon user request if the following are true:
  • Has not received any warnings, regardless of severity
  • Does not have any pending reports against them
  • Account balance in good standing; no outstanding invoices
If any of the above exist, you may request that your personal information be removed if you plan on leaving Art Haven, however, we do not have to delete your account. It will remain for record keeping purposes. This is to prevent malicious users from bypassing our warning systems and consequences.

Please Note: It is your responsibility to notify artists of pending commissions that you have decided to delete your account and where they can contact you offsite. Artists have the right to cancel your commission should they feel uncomfortable with communicating with you offsite.

HOW THE WARNING SYSTEM WORKS

USERS HAVE A PRIVATE WARNING LOG LOCATED UNDER THEIR REPUTATION ON THEIR PROFILE:

Our warnings work on a point system where the less points you have, the better. No user is allowed to have more than 5 points at a time. Users who reach 5 points with a combination of both DMCA violations and behavioral warnings, or 4 points with only DMCA violation warnings, will be permanently banned.

0 Warning Points - No official warnings issued
1 Warning Point - First official behavioral warning has been given
2 Warning Points - Second official behavioral warning has been given before the first has expired or a DMCA violation warning has been given
3 Warning points - A combination of behavioral and/or DMCA violation warnings have been given
4 Warning Points - Third official behavioral warning has been given before the first two have expired resulting in a two week ban, OR two DMCA violation warnings have been given resulting in a permanent ban
5 Warning Points - Permanently banned from Art Haven

Only staff will initially know why someone has received a warning. We believe in second chances and don't want users who have made mistakes in the past to be accosted on Art Haven. It is up to the user if they wish to disclose why they have received a warning; this is not against Art Haven rules. However, the user may not post negative complaints with the intent on being dishonest to others about why they have received a warning.

If you decide to publicize the warning under false pretense, we assume our right to clear up the situation to other users, both privately and publicly, including any information collected we used to determine the level of discipline you received. BEHAVIORAL WARNING LEVELS

Art Haven splits the warning system into two categories: Behavioral and DMCA Violations

LEVEL 1 - FRIENDLY REMINDER

Friendly reminders are what most of our warning progressions begin with and are common for lesser cases of rule breaking.

For Friendly Reminders you will not receive a point.

LEVEL 2 - OFFICIAL WARNING

Official warnings are given when:
  • You have broken a rule for a second time and have already received a friendly reminder about it in the last 6 months.
  • You have broken a rule that has a warning progression starting at an official warning, such as harassment.
You will have one one point added if you receive an official warning.

LEVEL 3 (First) - SECOND OFFICIAL WARNING

Second official warnings are given when:
  • You have broken a rule for a third time and have already received both a friendly reminder AND an official warning about it in the last 6 months.
  • You have broken a rule that has a warning progression starting at a second official warning, such as severe cases of harassment.
You will have another one point added and will be banned from Art Haven for two weeks if you receive a “second official” warning.

LEVEL 3 (Second) - FINAL WARNING

Final warnings are given when you receive another official warning that brings your total points up to 4. It does not matter if the warnings you received leading up to this were all associated with the same rule infraction.

You will have 1-2 points added depending on the warning and will be banned from Art Haven for two weeks.

LEVEL 4 - LOST POINT

These level of warnings are given as official warnings, but logged as lost points. If you break a rule and receive an official warning, have it expire and earn back your point, then break the same rule again, you will permanently have that point on your account, preventing you from ever having “full health”, or 0 points again.

LEVEL 5 - BANNED

Bans are given when:
  • You have broken a rule for a fifth time and have already received a friendly reminder, official warning, second official, and final warning about it in the last 6 months.
  • You have broken a rule that has a warning progression starting immediately with a permanent ban, such as severe cases of harassment (death threats).
  • You have received 4 official warnings, second official warnings, or final warnings combined in the last 6 months.
Bans are considered permanent, however, you may apply to come back to Art Haven one year from the date you were given a ban via our application process. More information regarding the application process is located here:

DMCA VIOLATION WARNING LEVELS

Copyright infringement is handled on a case-by-case basis. These are just starting guidelines we use to handle them and we may adjust consequences based on the severity of the case, but for the most part this is true to accuracy going along with our DMCA guidelines. We enforce these rules to be in compliance with the Digital Millennium Copyright Act(DMCA), a law that protects the intellectual property of a person.

LEVEL 1 - MINOR

Minor warnings are given when:
  • A new user has committed copyright infringement and was not aware of the theft they were committing. (We consider a new user a registered account less than 1 month old.)
  • You have committed a small case of copyright infringement, such as copying+pasting a small copyrighted image into your artwork. Pieces containing obvious copyright infringement or multiple infractions do not qualify for a minor warning.

You will receive two points if you receive a minor warning, but you will not receive a 30-day ban. You will never receive more than one minor warning. It will always be an Level 2 or Level 3 afterwards regardless of time passed.

LEVEL 2 - SUSPENSION

Official warnings are given when:
  • You have infringed upon the intellectual property rights of another user and committed a serious copyright infringement infraction
  • You have previously received a minor warning for copyright infringement related infractions 12 months+ ago.
You will receive two points and a 30-day suspension if you receive a Level 2 DMCA Violation.

LEVEL 3 - BAN

Bans are given when:
  • You have received any combination of two minor warnings, official warnings, or both.
  • Your case of copyright infringement is considered outstanding and supersedes what we cover in our guidelines.
Bans are considered permanent, however, you may apply to come back to Art Haven one year from the date you were given a ban via our application process. More information regarding the application process is located here:

GETTING YOUR POINTS REMOVED

ALL WARNINGS ARE LOGGED PERMANENTLY TO YOUR ACCOUNT AND WILL NOT BE REMOVED, EVEN AFTER THEY EXPIRE

This is our way of keeping a record of all warnings given and to whom. The date the warning was issued, reason why, and by which moderator is logged along with the warning that is sent to you. When a warning has expired, you will regain back any points lost and restrictions lifted that were given.

Warning expirations depend on the type of warning:
  • Behavioral warnings expire automatically after 6 months.
    Exception: Harassment and cases of scamming, both buyer and artist related, will take 12 months/1 year to automatically expire.
  • Reminder: Using the expiration dates as a timer to when you can break the same rule again will result in a lost bar warning, even if your warning has previously expired. This is considered gaming the system and we do not allow it.

TOPIC CONTROL: DELETION / LOCK

If you are done with your shop and would like to have it deleted or locked, you may do so with the following options:
  • Change the title of your shop to "Lock" or "Delete"
  • Delete all of your tags and add a “Lock” or “Delete” tag.
  • Post in this topic: Master Cleaning & Restoring
  • PM a Shops & Services Moderator with a link to your shop asking for it to be deleted
Note: Topics are automatically moved to the basket after a month of inactivity. Therefore, if you need to go on a hiatus, please let a moderator know so they can lock your topic. Locked topics are not deleted, even after one month of inactivity.

YOU MAY NOT SELL ARTWORK THAT DOES NOT BELONG TO YOU, EVEN IF PERMISSION IS GIVEN BY THE ARTIST

This includes:
  • Creating a shop to sell their artwork
  • Selling their artwork in the premade market
  • Selling their artwork in a request topic
  • Or Auctioning their artwork
If the work is found to be stolen, warnings will be given to both possible parties.

Note:This is slightly different than having a shop assistant. A shop assistant would be someone who organizes and accepts your orders and takes care of your business, which is completely fine. The person who is making the art must be the one to make the topic.

YOU MAY NOT HOST AN AUCTION OUTSIDE OF THE AUCTION HOUSE

Auctions are not allowed to be hosted outside of the Auction House section of the site. This is done to avoid confustion, dishonest bids, and failure to pay or deliver auction items. If you wish to hold an auction, you may apply to do so by submitting an auction application. Additionally, you are not allowed to host an auction both on Art Haven and through another site or social media platform. This is to make it easier to monitor the auction and avoid any potential conflict between bidders on Art Haven and other platforms.

YOU ARE ALLOWED TO HAVE AS MANY SHOPS OPEN AS YOU LIKE

You may have as many shops as you like as long as this opportunity is not abused. You can make separate shops for different things you are selling or you can make one shop for everything you're selling. However, you are not allowed to post the same shop more than once, as this can be considered spam. If you're done with your old shop and want to make a new one, remember to get the old one taken care of so there will be no confusion for potential customers!

YOU MAY NOT CREATE A TOPIC IN ANY OF THE ART SECTIONS OF ART HAVEN TO ADVERTISE SERVICES SOLD OFF-SITE

We do not allow this because we cannot monitor or control anything that is being sold off-site. It also makes no sense to use Art Haven to advertise it instead of simply selling it here. You may link to offsite shops in your signature instead.

YOU MUST GIVE CREDIT WHERE CREDIT IS DUE WHEN USING RESOURCES FOR YOUR ARTWORK

(E.G., BRUSH, STOCK IMAGE, PIXEL BASE) If you use a resource that requires you to "credit" the creator of the resource, you must provide credit. "Crediting" means to provide the source or origin of the resource. If you do not provide the proper credit, it is considered theft and warnings will be given. In order to properly provide credit, the two following things must be written visibly in your topic or in the same post as the artwork:
  • Name of what was used - You must specify what resources you used, whether it be a brush, a texture, a filter, a pixel base, a stock image, a drawing base, or anything else that could require crediting.
  • Who created it and a link to where it was taken from - You must include the name or username of the creator of the resource (if there is one provided) and include a link back to where the resource was originally posted.

ASKING FOR "FIRST FREE" IS NOT PERMITTED

It is up to the artist ONLY if they would like to give the first order of a shop for free or at a discounted price. Therefore, you should not go into a shop and ask them for the first order to be free unless the artist has stated otherwise. We have a whole part of Art Haven dedicated to free art! OCS CREATED USING TEKTEK AND OTHER DOLL MAKER SITES

There has been a big trend of making OCs using tektek and various other doll maker sites. This is perfectly fine, as long as you are not making profit from the design (as it's not 100% your creation). More importantly, you MUST credit the website you've used to make them!

ABIDE BY THE ARTIST'S RULES

Generally, artists have their own shop rules and guidelines. It's courteous to read through them before ordering so you are aware of their limitations and other things that may affect you.

FIND OUT BEFOREHAND WHETHER AN ARTIST SELLS CUSTOMS AS PREMADES

Artists are required to state in their rules whether or not they will sell custom orders as premades that have not been picked up/paid for. So to make sure a picture that was made for you doesn't get sold off as a premade, please read the artist's rules.

ALWAYS ASSUME THAT ART MADE FOR YOU IS FOR PERSONAL USE ONLY

Generally, art sold on Art Haven is for personal use only. Meaning, you cannot take artwork that has been made for you and make profit from it (selling it off as prints, making a product from it, etc.). If you want to use art for commercial purposes, make sure to ask the artist first before ordering.

CUSTOM SHOP RULES

YOU MUST STATE SOMEWHERE IN YOUR SHOP THAT YOU SELL ARTWORK THAT HASN’T BEEN PICKED UP/PAID FOR AS PREMADES

When you're making an image for someone, respect the fact that you are making art with their screenshot / based on their OC. Therefore, you MUST make it known to potential customers if you sell off artwork as premades that isn't picked up for/paid for. You cannot just decide to sell something off as a premade without the original customer’s consent.

YOU ARE ALLOWED TO SELL AN OCCASIONAL PREMADE IN YOUR CUSTOM SHOP

If you only plan to sell a couple of premades you may post them in your custom shop or better, post them in the premade market rather than create a new topic for them. This will actually make it easier on yourself to sell them in the long run. We are only going to force you to make a separate shop if you're going way over this limit (the limit being more than 10 premades a month.)

PREMADE SHOP RULES

PICK YOUR PRICE MEANS PICK YOUR PRICE

If you set the price of a premade to “pick your price”, or PYP, you cannot wait for offers to come in so that you can choose the highest one. These are considered to be more like auctions. If you wish to hold an auction, you may apply to do so in our [ Auction Section ]. This is why setting a minimum price is the best option to avoid lowball offers and possibly receiving consequences for not going with your first offer.

YOU MAY NOT OFFER CUSTOM ORDERS IN PREMADE SHOPS

This section is specifically reserved for premades. If you would like to offer customs, please post here [ Custom Shops ] .

ADOPTABLES ARE ALLOWED TO BE SOLD

An adoptable is a design/concept that is presented in the form of a drawing. Reselling adoptables is only allowed on Art Haven if you provide credit/links/proof that you have permission to re-sell.

Please note: If you are selling premade art, and the buyer decides to turn it into an OC, that is their decision, unless you have specifically stated otherwise during the point of sale.

PREMADE MARKETS

These rules are also posted in the premade market as a refresher every time you post.
  • Do not post premades in the market if you have a premade shop.
  • You may only post your premade(s) once within a 24 hour period.
    Exception: If you have a new premade and you are not reposting any older ones, then you can post again before 24 hours is up.
  • You MUST use the premade market form listed in the topic.
  • Images posted must follow the 700x700px max image size guideline we have in place.
  • If you are interested in buying a piece posted in the market, please PM the artist. DO NOT post within the topic regarding interest in a piece or to make comments.

FREE SHOP RULES

WHAT IS ALLOWED IN THE FREE SHOPS

There is a lot more freedom with what can and can't be offered in the Free Shops. The reason is because free shops = no profit gained from things that do not belong to you. These are the things that are ONLY ALLOWED to be made on the Free Sub-section:

EDITS / HEAVY REFERENCES OF NON COMMERCIAL PHOTOS
  • Photos of celebrities
  • Non-stock photos
  • Movie screenshots
  • Anime screenshots
  • Manga scans
  • Comic books scans

REMEMBER TO CREDIT YOUR SOURCES TO THE BEST OF YOUR ABILITY

For example, if you edit a photo of Natalie Portman then state "photo edited of Natalie Portman". Remember that editing Artwork/Photos from deviantart requires the artist's permission as well!

GIFS MADE FROM VIDEOS NOT CREATED BY YOU (MUSIC VIDEOS, ANIMES, YOUTUBE VIDEOS ETC)

Although making things into GIFs does take a bit of effort, you cannot make profit from making them for other people as you do not own the video content.

CONCERNING OC REFERENCES AND FANART

USING NON STOCK PHOTOS / DRAWINGS AS PART OF YOUR REFERENCES


It is okay to use a non-stock photo as part of a reference for your OC.

Example:

This is a nonstock photo from tumblr that I found randomly.
I would like to use it as a reference for my character's armour.

This is a painting by lulles .
I would like to use it as a reference for my character's hairstyle.

Even though, you do not own these images (you didn't take the photo + paint the drawing) you can use this image as a REFERENCE for how you would like the specific part of your OC to look like. Of course, using it as a reference does not give the artist permission to copy it exactly. You're only supposed to "reference" it to create your own original image.

USING NON STOCK PHOTOS AS YOUR ONLY REFERENCE

Although, it is okay to use a non-stock photo as part of your reference (clothing, haircolour, hair style, etc), you cannot ask someone to use a photo as their only source of reference.

Example:

This photo belongs to Bastet-sama .
I cannot give this to an artist to create a character based on this image. The design is the property of the person who took the photo.

This is a drawing made by Zeronis .
I cannot ask an artist to make a drawing of this character as I do not own it.

The only exception is fanart.

ASKING FOR FANART

This is where things get a bit confusing. You are allowed to ask for fanart from artists based on popular characters (Disney, Anime, Television, etc).

Example:

This is a fanart made by GENZOMAN of Edward Elric and Alphonse Elric from Full Metal Alchemist.
They used references from the Anime to create a new artwork.

This is the only time it is appropriate to copy a character design fully. If you're unsure if you're allowed to ask for a fanart of a certain thing, do not hesitate to contact a moderator! The lines are pretty blurry. Also, make sure to consult an artist before asking for fanart, because artists have their own views on doing fanart for commissions! Some do not believe drawing a copyrighted character for profit is acceptable.

RESELLING ARTWORK OF ORIGINAL CHARACTERS IS ALLOWED

You may only re-sell artwork if you own the original character( an Adoptable) and have written permission from the artist who made the artwork.

You may not re-sell fanart.

As of JULY 19, 2019,
It has become an exceedingly popular trend for users to “resell” artwork on our platform (Non-Adopts.) While we do not officially endorse this practice, we tolerated it for the sake of an open platform with only one requirement in place: You must have direct permission from the artist(s) who created the work(s).

Due to the incredible abuse in using our platform to resell art without proper permissions in recent weeks, we have been forced to discuss adding official regulations to our Community Guidelines regarding the reselling of any artwork that is not classified as an adoptable by its original creator. We encourage anyone to contact any staff member with suggestions on what we could do to allow this practice to continue without enforcing harsh restrictions. Until that course of action is decided upon, no reselling of artwork is allowed until further notice. This restriction is for artwork that is not classified as an adoptable by its original creator.

REQUESTS & ART TRADES

MAKING A "FREE" REQUEST (ONE WITH NO COMPENSATION FOR THOSE WHO ENTER) IS PROHIBITED OUTSIDE OF THE FREE REQUESTS SECTION OR FREE SHOP SECTION

You must be offering something of value if you want to commission custom artwork outside of these areas. This could include but is not limited to credits, money, or other acceptable game currencies. If you are looking for something made for free there is an entire sub- section devoted to this: [ Free Practice Shops ]

Please note that offering "advertising" is not something Art Haven considers to be suitable compensation in a request. "Advertising" means offering someone "credit" for their work (such as a link to their shop in your signature / on your products / etc). Feel free to offer as an additional bonus to entering a request, but it CANNOT be the only thing you are offering as compensation.

SENDING PAYMENT TO ARTISTS IN ADVANCED IS DONE AT YOUR OWN RISK

Sending payment in advance should be agreed upon by both the artist and the requester and is to be done at your own risk. Should the artwork not be completed, Art Haven will not reimburse lost currency.

YOU MAY NOT REQUEST PEOPLE TO HEAVY REFERENCE / TRACE AN IMAGE THAT YOU DO OWN COPYRIGHT OF

If you are knowingly paying for something to be reproduced and you do not own rights to that image, then it is considered copyright infringement. Similarly, if you create something that would be considered copyright infringement for a request you will receive an official warning. Should this occur, warnings will be given to both the requester AND the artist.

ABIDE BY THE REQUESTER'S RULES

Generally, requests have their own set of rules. Be sure to read the request thoroughly before entering! For example--a lot of times requesters post what they like or dislike so try and keep that in mind while you are working on an image for them

IF YOU ARE MAKING A REQUEST, YOU MUST MAKE IT KNOWN SOMEWHERE IN THE RULES IF PEOPLE ARE NOT ALLOWED TO SELL UNWANTED WORK AS A PREMADE

You must let them know ahead of time so they can consider the risks of making artwork and receiving no compensation for it. Otherwise, they are justified in selling as a premade if you have no intention of buying it.

On the flip side, if the Requester has clearly stated you cannot sell work as premades if they don't like it, you must respect that. The only time someone may sell something off as a premade, regardless of what the requester says, is if it is based around a generic concept.

For example: If you ask for a badge of a cookie and you choose not to buy it, then the person is free to sell it as a premade. You do NOT own the concept of a "cookie".

If they are using your screenshots or basing art on your OC, then you "own" the concept and can prohibit them from selling it as a premade. Should this happen, please submit a ticket via our support section.

YOU MAY NOT USE SOMEONE ELSE'S SCREENSHOT / OC / ARTWORK AS PART OF A REFERENCE FOR A REQUEST

Please ask permission to the original owner of the OC / screenshot / artwork before doing so.

ART TRADES ARE PERMITTED

Art trades are perfectly acceptable to be held in the designated art trade section of Art Haven as something of equal value is being traded amongst users. Please note, Art Haven cannot be held responsible if someone does not complete their part of the art trade.

HOSTING A CONTEST OR EVENT

BE AWARE THERE ARE MANY DIFFERENCES BETWEEN A CONTEST AND A REQUEST

Understanding them is key to hosting them on the proper part of Art Haven.

A Contest - requires you to give out a limited amount of prizes (usually prizes are given to the top entries). Therefore, not everyone entering the contest will be rewarded something.

A Request - requires you to give out compensation to every image you like and plan to use. Therefore, most who enter will receive something in return.

EVENTS / CONTESTS BASED AROUND LAYOUT OR IMVU PRODUCTS (TEXTURES AND MESHES) ARE PERMITTED.

ALL CONTESTS MUST STATE THE FOLLOWING IN THE "OPENING" POST(S) OF THE CONTEST TOPIC:

  • The rules
  • The prizes/compensation
  • Who the judges are
  • The deadline (the end date of the contest)

CHANGING THE END DATE OF A CONTEST IS PROHIBITED

Changing the end date of a contest / event makes it unfair for those who are entering. If there is a serious reason why you must change the end date of a contest, please talk to an Event Coordinator before doing so.

EVENTS/CONTESTS MAY NOT BE LONGER THAN ONE MONTH FROM START TO END UNLESS APPROVED BY AN EVENT COORDINATOR

This is to ensure that all contests in the Events sub-section remain "active".

"ADVERTISING" IS PROHIBITED FOR OFFSITE CONTESTS

"Advertising" in this case means creating a topic to promote a contest held offsite.

RUNNING A FALSE EVENT/CONTEST OR KEEPING CREDITS SUPPLIED BY A SPONSOR FOR YOUR CONTEST IS STRICTLY PROHIBITED

We consider this fraud and will result in a warning with a possible bar dock/ ban. In the most severe cases, we may prohibit you from hosting events ever again on Art Haven.

REQUESTING PERSONAL INFORMATION IN ORDER TO ENTER A CONTEST / WIN A PRIZE IS PROHIBITED

This includes but is not limited to:
  • Name
  • Address
  • Age
  • Real life photos
  • Credit card information
  • Birthdate

WE RESERVE THE RIGHT TO LOCK YOUR REQUEST AT ANY TIME

Should any of the following occur we will not hesitate to lock your request:
  • An inactive Contest / Event host
  • A Contest / Event suspected of being fraudulent
  • A Contest / Event that does not follow Art Haven rules
If your Contest/ Event was locked, feel free to contact a moderator and we will gladly assist you.

CREATING AN "UNFAIR / RIGGED" CONTEST / EVENT IS PROHIBITED

We consider the following to be an "unfair / rigged" event/contest:
  • Accepting bribes in order to win the contest
  • Being biased towards friends or popular artistst
This will result in your request being held under review to see if any further action is needed, and can result in an added warning point/temporary ban or permanent ban on your account.

Entering A Contest Or Event

YOU CAN ONLY PARTICIPATE IN AN EVENT/CONTEST DURING THE TIME SPAN PERMITTED

Submitting an entry late will not be counted.

IF YOU ARE UPSET BY THE OUTCOME OF A CONTEST, DO NOT HARASS THE WINNER

It is unreasonable to think that a contest is not and cannot be won fair and square. Be aware that any harassment and torment may result in a warning. However, if you believe someone may have cheated and have substantial proof of this wrongdoing please contact a moderator instead of posting in the topic about it.

ALL NON-OFFICIAL ART HAVEN EVENTS/CONTESTS ARE TO BE ENTERED AT YOUR OWN RISK

As moderators, all we can do is add warning points and issue bans. We cannot make up for lost prizes.

CHEATING IS PROHIBITED

Please follow the rules of the contest! The following can be considered as cheating:
  • Bribing the host
  • Swaying the votes in your / someone else's favour
  • Getting information in order to complete a contest by another user

OFF TOPIC RULES

OFF-TOPIC POSTS WILL NEED ADMIN APPROVAL BEFORE IT CAN BE VIEWED BY THE PUBLIC

Every topic created in the OT will not immediately show after posting. The Administration team, consisting of the Coordinators and Administrators, will decide whether or not to approve a topic based on its content.

TOPICS MUST HAVE SOME SORT OF POINT/DISCUSSION GOING ON

Topics must encourage participation and discussion from other users! For example these are some of the topics that are not allowed to be posted in the OT:

Spam topics - Spam = Short, Pointless, Annoying, Messages.
  • Posting a topic with only "hi" or an emoticon would fall under this category. We have ONE topic for "spammy" messages - this is the OT4OT.

NON-DICUSSION TOPICS

  • This is a topic that created as sort of an "Announcement" instead of actually encouraging discussion.
  • "Happy Birthday Bob" - creating a topic for someone's birthday, although this is a kind gesture, you can wish them a happy birthday via PM or via our Birthday OT topic, which can be found [ here ]
  • "Look at how cute my pet mouse is" - Creating a topic just to show off something of yours also doesn't encourage conversation from others.

SEXUALLY-THEMED TOPICS

The website is intended to be GA and open for users over the age of 13. Please refrain from posting Explicit Content where it is not allowed.

ADVERTISEMENT TOPICS

You are not allowed to create a new topic in the OT to advertise something (this could be your products, services, etc.)

"GOSSIP" TOPICS TARGETING ONE SPECIFIC PERSON OR GROUP

You are not allowed to create a new topic simply to talk about another person in a negative light. It does not matter if they are a member of Art Haven or not.

GAME TOPICS MUST BE APPROVED BY SOMEONE IN THE ADIMINISTRATIVE GROUP

Feel free to create your game topic but know your topic will not be posted in the OT until a Coordinator or Administrator approves it. Do not be upset if we do not approve your topic, we intend on keeping spammy / repetitive topics to a minimum.

GAME TOPICS SHOULD HAVE THE RULES POSTED IN THE FIRST POST.

Should you abuse the Off-Topic, you will be denied access to it. Of course, you can still use the other sections of Art Haven, you just will not be allowed in the OT anymore.
